In a recent ruling, the Hon’ble Supreme Court has expunged the adverse remarks made by the Hon’ble Rajasthan High Court against a Judicial Magistrate, who had granted bail to an accused based on parity with the co-accused and existing precedents. The Hon’ble High Court had criticised the order as “grossly inappropriate” and indicative of “indiscipline and ignorance,” ordering the matter to be placed before the Chief Justice. Allowing the Ld. Magistrate’s appeal, the Hon’ble Apex Court noted that such strictures were passed without hearing the officer, further, the Hon’ble Bench placed reliance on certain precedents and reiterated that High Courts across the nation must refrain from publicly censuring subordinate judges in judicial orders. Additionally, the Hon’ble Supreme Court observed that the Hon’ble High Court’s criticism was based on the judgment in Jugal v. State of Rajasthan, which ended up being overruled. However, emphasizing the need to be aware of an individual’s Criminal antecedents while granting bail, the Hon’ble Bench also recommended that High Courts across India should consider adopting a rule requiring disclosure of previous criminal cases and prior bail attempts1.
