The Delhi High Court has called upon the Bar Council of India (BCI) as well as the Bar Council of Delhi (BCD) to frame a policy providing financial aid to the families of deceased lawyers.
- The Hon’ble Court highlighted that lawyers’ income ends with their demise, leaving families financially stranded. The Hon’ble Court stressed that advocates’ families should not be pushed into “abject penury” due to lack of support.
- The case arose from an appeal by the mother of a deceased lawyer, who sought a Rs. 10 lakh life insurance claim under the Chief Minister Advocate Welfare Scheme. Her claim was rejected as the policy was activated two months after her son’s death
- The Hon’ble Court clarified that the Advocates Welfare Fund Act, 2021 only supports advocates during their lifetime and not posthumously. The Bar Council of Delhi has already extended monthly financial aid for two years to the appellant.
- The Hon’ble Court refused further relief but gave her the liberty to approach BCI/BCD for benefits under the Advocates Welfare Fund.
- The Hon’ble Court pressed BCI and BCD to create a lasting welfare scheme to ensure financial security for advocates’ families after their death.
