Delhi HC: Ensure Reservation for Transgender Candidates in Public Employment.

The Hon’ble Delhi High Court has directed the authorities to take appropriate decisions for providing relaxation of 5 years age and qualifying marks to the extent of 5% to transgender persons in public employment concerning recruitment to various posts in the Court establishment.

  • The Hon’ble Court noted that despite the 2014 NALSA Supreme Court judgment, proper steps for transgender welfare in public employment were not taken.
  • The Hon’ble Court also referred to the Transgender Persons (Protection of Rights) Act, 2019, stating that government obligations under the Act have not been fully implemented.
  • The case arose from a plea by Praveen Singh, who pointed out that a Delhi Government notification from February 8, 2021, provided age and marks relaxation for transgender persons, but recruitment to the various posts in the Establishment of Delhi High Court do not follow the rules.. Authorities did not provide reservation, age relaxation, or marks relaxation in the recruitment notification, leaving many transgender candidates unable to apply.
  • The Hon’ble Court directed the authorities to provide 5 year age relaxation and 5% marks relaxation and to extend the application deadline by one month, ensuring transgender applicants can benefit.
  • The case will be heard next on November 19, and the Delhi Subordinate Services Selection Board (DSSSB) must publicize the relaxations widely.
