Name of the Case: Sukdeb Saha v. State of Andhra Pradesh & Ors.
Citation: 2025 INSC 893
Hon’ble Supreme Court’s Bench: Justice Vikram Nath and Justice Sandeep Mehta
Date: 25.07.2025
In a landmark judgment, the Hon’ble Supreme Court set aside the Hon’ble Andhra Pradesh High Court’s refusal to transfer investigation of a NEET aspirant’s unnatural death to the CBI, given glaring inconsistencies in the probe by local police, suppression of key evidence, and lack of impartiality. The Hon’ble Court directed immediate transfer of the investigation to CBI, highlighting the broader crisis of student suicides driven by academic pressure, institutional indifference, and systemic failures in educational environments.
Recognizing the increasing incidents of student suicides, the Hon’ble Supreme Court also issued immediate interim guidelines for all educational institutions including schools, universities, colleges, and coaching centers. These guidelines focus on both, preventive and remedial mental health frameworks. These include mandatory appointment of qualified counsellors, regular sensitization of staff and parents, establishment of confidential redressal mechanisms for bullying and discrimination, suicide prevention protocols, and special safeguards in coaching hubs. The Hon’ble Apex Court further underscored that the right to mental health and suicide prevention shall continue to be an integral part of Article 21 of the Constitution, until a comprehensive legislation is enacted to safeguard the same1.
