The Hon’ble Madhya Pradesh High Court suspended the life sentence of a man convicted in a murder case, after noting that he had spent over 10 years in custody and two of his co-accused having spent similar time in custody had already been enlarged on bail.
- The accused was convicted under Sections 302 (murder) and 149 (unlawful assembly) of IPC and sentenced to life imprisonment. The Hon’ble Court allowed his plea for suspension of sentence and bail on furnishing a ₹50,000 bond with two solvent sureties.
- As a condition, The accused must plant and take care of 10 trees (fruit-bearing or Neem/Peepal) and regularly submit photographs. He is required to upload pictures of the saplings through the NISARG App, which uses satellite and geo-tagging for monitoring.
- The Hon’ble Court clarified that bail was granted on legal merits, and tree plantation is an additional responsibility, not the sole reason for release.
- The Hon’ble Court said this move aims to replace violence with compassion and harmony with nature and the bail will be cancelled if he harasses the complainant or fails to comply with the tree-planting condition.
