The Appeal was preferred to set aside or quash the order passed by the Hon’ble Railway Claims Tribunal, Principal Bench, Delhi, whereby the claim for statutory compensation on account of the death of their son was dismissed due to presumption that the ticket expired midnight. The Hon’ble High Court stated that the legitimacy of the claim cannot be rejected, especially when credible evidence exists of ticket purchase before the journey and further observed that presuming that the validity of the journey ticket expired at midnight would result in grave prejudice to the passengers who undertake late-night travel.
