Delhi HC Allows 22-Week Abortion After False Promise of Marriage

The Hon’ble Delhi High Court has permitted a 30-year-old unmarried woman to undergo medical termination of her 22-week pregnancy which resulted from sexual relations established with a man on the false promise of marriage

  • The pregnancy happened after she was in a two-year live-in relationship with a man who promised marriage but later abandoned her.
  • She told the Court that the man had forced her to abort a previous pregnancy in December 2024. When she became pregnant again in June 2025, he assaulted her when she refused to abort and then left her. Based on her complaint, an FIR was registered against the man.
  • The Hon’ble Court held that the pregnancy was unwanted which had caused the woman severe physical and mental trauma, and continuing it would worsen her suffering and social stigma. A medical board at AIIMS confirmed she was healthy enough for the procedure for abortion and that it was safe.
  • The Hon’ble Court stressed that the woman’s decision to continue or end the pregnancy must be respected. The Hon’ble Court ordered that the termination be carried out immediately at AIIMS, and directed the Investigating Officer to preserve fetal tissue for DNA tests as part of the ongoing criminal case.
