Case:- KAILASH RAMCHANDANI v. STATE OF MAHARASHTRA
Citation:- SLP(Crl) No. 4276/2025
Date:- 04.09.2025
Supreme Court Bench:- Justice Surya Kant and Justice Joymalya Bagchi.
The National Investigation Agency informed the Hon’ble Supreme Court today that it is holding consultations with States on the constitution of dedicated NIA Special Courts and a positive decision may likely be reached soon.
- The Hon’ble Court underlined the importance of time-bound trials, noting that criminals often delay cases for years, forcing courts to grant bail.
- The NIA explained that States need to be taken on board, since the power to constitute special courts lies with them.
- The Hon’ble Court told the NIA to at least commit to budgetary allocation, while other issues with States and High Courts could be worked out later.
- The NIA also shared details of a pending proposal: ₹1 crore as a one-time setup expense, ₹60 lakhs annually for recurring expenses, while States would provide land and buildings.
- During the hearing, the petitioner pointed out that his client has been in custody for over 6 years and the only evidence is “just one phone call.”
- The Supreme Court said it did not want to dismiss the case immediately and will hear it further on a non-miscellaneous day.
