Name of the Case: ABC v. The State of Maharashtra & Ors.
Neutral Citation: 2025:BHC-AS:24332-DB
Honourable Bombay High Court’s Bench: Justice Revati Mohite Dere and Justice Dr. Neela Gokhale
Date: 19th June 2025
The petitioner has filed the present writ petition seeking permission to medically terminate her pregnancy, which has advanced to 25 weeks. The pregnancy is stated to have resulted from the failure of a contraceptive device used by the Petitioner and her partner to avoid conception. The Petitioner contended that the continuance of the pregnancy is causing her a tremendous amount of anguish, constituting a grave injury to her mental health. The Hon’ble High Court, conscious of the right of the Petitioner to reproductive freedom, her autonomy over her body and her right to choice and considering the findings and opinions of the Medical Board on psychological condition of the Petitioner concluded that the continuance of the pregnancy shall adversely affect the already disturbed psychological condition of the Petitioner. Moreover, the Respondent No. 6, Partner of the Petitioner, has offered to deposit an amount of Rs. 1,00,000 in the account of the Petitioner for medical and legal expenses to be incurred by her. Hence, the Hon’ble High Court allowed the Petitioner to medically terminate her pregnancy.1
